These terms and conditions of sale are entered into by the company La Virgule SAS, with a share capital of 100,000 euros, whose head office is located at 34 Boulevard Carnot, 59800 Lille, registered with the Lille Trade and Companies Registry under the number 89086347500020, hereinafter referred to as LA VIRGULE, and which manages the website https://lavirgule.eco, and by any individual or legal entity wishing to make a purchase via the website, hereinafter referred to as https://lavirgule.eco "the buyer".

 

Article 1. Object

The present conditions of sale aim to define the contractual relations between LA VIRGULE and the buyer, and the conditions applicable to all purchases made through the https://lavirgule.eco website. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the https://lavirgule.eco website is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale.
LA VIRGULE reserves the right to modify these terms and conditions of sale at any time, in order to comply with new regulations or to improve the use of its site. Consequently, the applicable conditions will be those in force at the date of the buyer's order.

 

Article 2. Products

The products offered are those shown on the https://lavirgule.eco website of LA VIRGULE, while stocks last. LA VIRGULE reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible, but are not binding on the Vendor. In particular, computer covers vary from one product to another. The buyer is aware that the product purchased is upcycled. The materials of which it is made may therefore have traces of this past life, and colors may vary slightly, so please bear with us. The sale of products presented on the https://lavirgule.eco website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

 

Article 3. Prices

The prices appearing on the product sheets of the internet catalog are in Euros (€) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. LA VIRGULE reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, according to the total amount of the order. In metropolitan France, the buyer will be billed a flat-rate contribution to shipping costs of €4 including tax (unless delivery is offered). This amount rises to €8 (incl. VAT) for shipments to available European countries. See article 7.

 

Article 4. Order and payment terms 

LA VIRGULE offers the buyer the option of ordering and paying for its products in several stages, using a secure credit card payment system (via Stripe). These are detailed below:
The buyer selects the products he/she wishes to order and adds them to the shopping cart. On the shopping cart page, the buyer can modify product quantities if required. They then click on Payment to fill in their delivery and payment details.

Steps 1 and 2 ask the buyer to fill in their contact details and delivery address. The billing address is requested in step 4.

Shipping costs are calculated and submitted to the buyer at the end of step 2. 2 options are proposed: home delivery or hand delivery to Lille. If the buyer chooses the "hand delivery in Lille" option, he/she is aware that this option requires him/her to travel to the city of Lille so that one of our staff can deliver the order.

The buyer then clicks on the "Continue" button. The buyer can add a message of encouragement or clarification to the order in step 3.

The buyer can then safely enter his personal credit card details. They can add a billing address if different from the delivery address. They then click on the "Continue" button. At this stage of the order, the buyer is still not invoiced. In the last step, the buyer checks all the information, as well as the general terms and conditions of sale and the returns policy. By clicking on "Buy", the customer validates payment for the order. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. 

In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges incurred, the cardholder must contest the debit in writing to his or her bank within 70 days of the transaction, or 120 days if provided for in the contract. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder's written objection. The cardholder will not be charged for the return of the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge of them, and waiver of the right to invoke one's own terms and conditions of purchase. All data supplied and the recorded confirmation will constitute proof of the transaction. LA VIRGULE will send confirmation of the order by email.

Article 5. Reservation of ownership 

LA VIRGULE retains full and complete ownership of the products sold until full payment has been received, in principal, fees and taxes included.

 

Article 6. Withdrawal and refund

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of the order to exercise his right of withdrawal and return the product to the seller for exchange or refund.

Used products will not be refunded or exchanged. The product must be returned intact and suitably packaged.

 

Article 6.1. Exchange

To make an exchange request, the buyer must follow the steps below for the request to be effective:

- Send a message on the form within 14 working days of dispatch of the order, indicating the order number and the exchange request.

- After validation by our teams, the buyer will receive a return slip. The buyer must indicate on the return form the full name, address, email address, telephone number and order number. Without this, LA VIRGULE will not be able to process the request.

The buyer pays the return shipping costs of 8€.the parcel is then received by our shipping department.upon receipt, the new product is shipped within 5 working days.
In the event of an exchange, LA VIRGULE will pay the shipping costs for the new product.

 

Article 6.2. Refund

To request a refund, the buyer must follow the steps below:
- Send a message on the form within 14 working days of dispatch of the order, indicating the order number and the refund request.
- After validation by our teams, the buyer will receive a return form. The purchaser must indicate on the form the full name, address, email address, telephone number and order number. Without this, LA VIRGULE will not be able to process the request.

Upon receipt of the product at our shipping center, LA VIRGULE is notified and issues the refund within 7 days.
The refund is the amount of the product(s) returned, minus the €8 return postage. The refund will be made directly to the buyer's credit card.

 

Article 7. Shipping

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Delivery costs are indicated at the checkout stage of the order and on each product sheet.
Deliveries are made by La Poste via COLISSIMO, a tracked delivery service, in France and other available European countries (Germany, Austria, Belgium, Spain, Italy, Luxembourg, Netherlands, Portugal).

Delivery times are given as an indication; if they exceed thirty days from the order, the sales contract may be cancelled and the purchaser reimbursed (except if the product indicates the mention "Pre-order"). LA VIRGULE may provide the buyer with a tracking number by e-mail. The buyer is delivered to his home by his letter carrier. If the purchaser is absent, he/she will receive a delivery notice from the letter carrier, allowing him/her to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of LA VIRGULE. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage in transit, any protest must be made to the carrier within three days of delivery.
If the purchaser chooses the "Hand delivery in Lille" option, LA VIRGULE will contact the purchaser to make an appointment to deliver the product in Lille only.

 

Article 7.1. Pre-order delivery

Some products are sold as pre-orders. This is expressly mentioned on the product sheet and indicates an expected delivery date. This date is given as an indication. LA VIRGULE will do its utmost to deliver pre-orders on time, but cannot guarantee delivery on the date indicated. Furthermore, the confirmation email may mention delivery within 2-3 working days, but this does not apply to pre-orders. 

 

Article 8. Guarantee

All products supplied by LA VIRGULE are covered by the legal warranty stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to LA VIRGULE, who will take it back, exchange it or reimburse it. Non-conformity must take into account article 2 relating to the past life of our raw materials. Requests for exchanges and refunds are detailed in article 6.

 

Article 9. Responsibility

LA VIRGULE, in the distance selling process, is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service, or other involuntary problems.

 

Article 10. Intellectual property 

All elements of the https://lavirgule.eco site are and remain the exclusive intellectual property of LA VIRGULE. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text. To promote the brand, please contact us via the form!

 

Article 11. Personal data

LA VIRGULE is committed to preserving the confidentiality of information provided by the purchaser, which he/she may be required to transmit in order to use certain services. All information concerning the purchaser is subject to the provisions of law n° 78-17 of January 6, 1978. As such, Internet users have the right to access, modify and delete information concerning them. They may request this at any time via the form.

 

Article 12. Dispute resolution 

These conditions of distance selling are governed by French law. For all disputes or litigation, the competent court will be that of Lille.
