Terms of Sales

These terms and conditions of sale are entered into by the company La Virgule SAS, with a share capital of 100,000 euros, headquartered at 34 Boulevard Carnot, 59800 Lille, registered in the Lille Trade and Companies Register under number 89086347500020 hereinafter referred to as LA VIRGULE and managing the https://lavirgule.eco website, and by any individual or legal entity wishing to make a purchase via the https://lavirgule.eco website, hereinafter referred to as "the buyer".

Article 1. Purpose
The purpose of the present conditions of sale is to define the contractual relationship between LA VIRGULE and the buyer, and the conditions applicable to all purchases made through the https://lavirgule.eco website. The acquisition of a product through the present site implies unreserved acceptance by the buyer of the present conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the https://lavirgule.eco website is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale. LA VIRGULE reserves the right to modify these terms and conditions of sale at any time, in order to comply with new regulations or to improve the use of its site. Consequently, the applicable conditions will be those in force at the date of the buyer's order.

Article 2. Products

The products offered are those shown on the https://lavirgule.eco website of LA VIRGULE, while stocks last. LA VIRGULE reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible, but are not binding on the Vendor. In particular, computer covers vary from one product to another. The buyer is aware that the product purchased is upcycled. The materials of which it is made may therefore have traces of this past life, and colors may vary slightly, so please bear with us. The sale of products presented on the https://lavirgule.eco website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices
The prices shown on the product sheets of the internet catalog are in Euros (€) and include all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. LA VIRGULE reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, according to the total amount of the order. In metropolitan France, the buyer will be billed a flat-rate contribution to shipping costs of €4 including tax (unless delivery is offered). This amount rises to €8 (incl. VAT) for shipments to available European countries. See article 7

Article 4. Order and terms of payment

The company La Virgule offers the buyer to order and pay for his products in several stages, by means of a secure payment by credit card (via the supplier Stripe). Here they are in detail:

The buyer selects the products he wishes to order and adds them to the basket. On the basket page, the buyer can modify the quantities of the products if necessary. They then click Payment to fill in their delivery and payment information.

Steps 1 and 2 ask the buyer to fill in their contact details as well as the delivery address. The billing address is requested in step 4.

Shipping costs are calculated and submitted to the buyer at the end of step 2.
2 options are available: home delivery or hand delivery in Lille. If the buyer chooses the “Personal delivery in Lille” option, he is aware that this option requires him to travel to the city of Lille so that one of the employees can deliver his order.

The buyer then clicks on the “Continue” button. The buyer can add a message of encouragement or clarification on the order in step 3.

The buyer can then enter his personal credit card references in complete security. He can add a billing address if it is different from the delivery address. He then clicks on the “Continue” button. At this time of the order, the buyer is still not invoiced. The last step allows him to verify all the information as well as to read the general conditions of sale as well as the return policy.
By clicking on “Buy”, the customer validates the payment of his order. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by credit card is irrevocable.

In case of fraudulent use of it, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited or returned. The responsibility of the holder of a credit card is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the direct debit from his bank, within 70 days following the transaction, or even 120 days if the contract binding him to the latter so provides. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the bearer. No cost of restitution of the sums can be charged to the holder.

The confirmation of an order entails the acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. The company La Virgule will communicate by email the confirmation of the registration of its order.

Article 5. Retention of title

La Virgule retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal and reimbursement

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund.

Any product used will not be refunded or exchanged. It must be returned intact and properly packaged.

Section 6.1. Exchange

To make an exchange request, the buyer must follow the following steps for the request to be effective:
- Send an email to bonjour@lavirgule.eco within 14 working days after dispatch of the order, indicating the order number and the exchange request.
- After validation by our teams , the buyer must, at his own expense, return the product(s) to the address below. The buyer will indicate on paper surname, first name, address, email, telephone number as well as the order number. Without this, La Virgule will not be able to process the request.

In the event of an exchange, the shipping costs of the new product are borne by La Virgule.

Section 6.2. Repayment

To request a refund, the buyer must follow the following steps for the request to be effective:
- Send an email to bonjour@lavirgule.eco within 14 working days after dispatch of the order, indicating the order number and the refund request.
- After validation by our teams , the buyer must, at his own expense, return the product(s) to the address below. The buyer will indicate on paper surname, first name, address, email, telephone number as well as the order number. Without this, La Virgule will not be able to process the request.

The refund will be made directly to the buyer's credit card using the Stripe payment module managed by La Virgule.

Article 7. Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. The delivery costs are indicated at the payment stage of the order and in each product sheet.

Deliveries are made by La Poste via COLISSIMO, delivery service with tracking, in France and in the other European countries available (Germany, Austria, Belgium, Spain, Italy, Luxembourg, Netherlands, Portugal).

Delivery times are indicative ; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed (unless the product indicates the mention “Pre-order”). The company La Virgule will be able to provide the buyer with the tracking number for their package by e-mail. The buyer is delivered to his home by his postman. In the event of the buyer's absence, he will receive a delivery notice from his postman, which allows him to withdraw the products ordered from the nearest post office, for a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the company La Virgule. The buyer is required to check, in the presence of the La Poste employee or the deliverer, the condition of the packaging of the goods and its contents on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

If the buyer chooses the “Personal delivery in Lille” option, La Virgule will contact him to set up an appointment for delivery of the product in Lille only.

Section 7.1. Pre-order delivery

Some products are sold in pre-orders. This mention is expressly expressed on the product sheet and indicates an expected delivery date. This date is given as an indication. La Virgule does its best to deliver pre-orders within the times expressed but cannot guarantee delivery on the date indicated. In addition, the confirmation email may mention delivery within 2-3 working days, this mention does not concern pre-orders.

Article 8. Warranty

All the products supplied by the company La Virgule benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to La Virgule, which will take it back, exchange it or refund it. The non-conformity must take into account article 2 related to the past life of our raw materials. Requests for exchanges and refunds are detailed in article 6 .

Article 9. Liability

The company La Virgule, in the distance selling process, is bound only by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 10. Intellectual property

All elements of the https://lacomma.eco site are and remain the exclusive intellectual property of La Virgule. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text. Article 11. Personal data

The company La Virgule undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 12. Settlement of disputes

These distance selling conditions are subject to French law. For all disputes or disputes, the competent Court will be that of Lille.
